Ijdelea & Associates’ dispute resolution team has recently secured a significant win for XL Insurance and SUPECO Investment, in a complex litigation case in the field of property insurance.

The court granted approx. 4 mil RON in damages in favor of their clients, holding the defendants liable following a dispute that raised complex legal challenges. The case involved issues related to the distribution of liability between the owner of a leased space and the contractors engaged to fulfil contractual obligations, as well as the overlap between tort and contractual liability.

Beyond the legal challenges, the case also involved technical issues around fire protection systems, the particularities of retail activity and public health risks, influencing damage evaluation.
