Professional underperformance is not expressly regulated by the Labor Code, yet it remains a reality familiar to every organization. It lacks a clear legal definition and remains outside any consistent framework of interpretation. While frequently conflated with insufficient competence, underperformance may also manifest as a subtler form of resistance: the refusal to assume one’s role, disengagement from collective benchmarks, or an inability to operate within a professional environment governed by rules, objectives, and shared accountability. Its expressions range from nuanced and difficult-to-quantify declines to recurrent and conspicuous failures.
This seminar seeks to bring legal rigor and operational clarity to an area long marked by uncertainty. Our objective is to articulate a legal meaning of professional performance, to examine the mechanisms that undermine it, and to explore the employer’s available courses of action, bearing in mind that there are no “one size fits all” solutions.
