DOUBLE ESPRESSO: Competition in Labour Relations under the Spotlight of the Competition Council. The Line Between Permissible and Prohibited

We invite you to a new edition of the Double Espresso series, dedicated to a topic that has recently been the focus of attention of the authorities: the application of competition rules in labour relations.

A recent investigation by the Competition Council, which resulted in significant fines for agreements between employers regarding staff recruitment, confirms that practices traditionally associated with recruitment processes, commercial collaboration, or employee mobility may fall within the scope of competition rules. For companies, the Competition Council's decision highlights the need to carefully reassess interactions with competitors, certain contractual clauses, and internal hiring rules.
