AmCham Romania calls for constructive dialogue and broad consultations with all relevant stakeholders, to secure the checks and balances, the rule of law, the independence of justice and fight against corruption

 AmCham Romania reaffirms its support for the fundamental values and principles that need to be observed across the decision making and social spectrum to enable Romania’s further development, general wellbeing and consolidation of its democracy and rule of law.

In AmCham’s view, Romania’s transformation and the strengthening of its strategic position must be founded on solid basis, such as:

  • The balance of powers in the state, independence of justice, increasing the capacity of good governance and fighting corruption and abuse of power.
  •  A modern, efficient and ethical state, by respecting institutional roles, transparency, accountability and consistent and equitable law enforcement;
  • The materialization of Romania's economic and political potential as a regional strategic vector of stability, security and prosperity in the Euro-Atlantic area, doubled by equitable welfare and development opportunities for every citizen and future generations.
  • Curbing corruption which remains a serious and direct threat to national security and a major obstacle to the development of Romania by capturing and wasting critical resources at the expense of strategic national projects, that Romania badly needs in order to close the gaps in key areas for both the society and the economy.
  • Stronger structural reforms and consistent and unbiased law enforcement measures, the elimination of institutional distortions, the misappropriation of institutional tools and mechanisms from their legal and constitutional purpose and mandate.
  • Avoiding any political, economic, justice and media interference, the release of arbitrary filters operation, resolution of major cases of corruption and tax evasion, without abuse and inappropriate influences, with emphasis on the conditions of legality, effective and timely recovery of damages and prevention.

It is necessary that state institutions act within the limits of their constitutional parameters, observing the democratic values, through real public consultations and constructive institutional dialogue within a reasonable amount of time for all interested parties, towards the following directions that we consider priorities for Romania:

  • Transparent debate on the justice law package, based on modern policies and good practices in the field.
  • Structural reshaping and modernization of systemic institutional mechanisms through the establishment of effective instruments of democratic control and equilibrium that guarantee the separation of power within the state, ensuring autonomy, ethics and integrity in order to protect the general interest.
  • Ensure an independent and effective justice within the constitutional framework, free of partisan interference, politicization and enclaves.
  • Modernizing the organization and functioning laws of the main state institutions by establishing and strengthening verification mechanisms and accountability instruments, including real and effective parliamentary and civil control, separating legal and operational competencies, establishing the limits of action and the guarantees for observing the rule of law, fundamental rights and freedoms, introducing ethics and integrity rules and standards, performance and control of risks.
  • Pragmatic implementation of good governance rules, especially with regard to transparency and predictability at all levels of the legislative process.
  • Structural reforms to strengthen the rule of law and institutional modernization.
  • Adopting a consensual multi-generational country model for a prosperous Romania with a vibrant and competitive identity, common values and sustainable performance areas, a regional and European stability anchor, and a predictable and credible strategic partner.

Given the importance and urgent need of reforming the justice system in order to strengthen the state of law on a consensual basis, we appeal equally to constructive dialogue and substantiated contributions from all relevant political and civil society stakeholders.
