STOICA & Asociații: Analysis of the General Urban Plan of Bucharest

by STOICA & Asociatii May 12, 2022

The decision of approval of the G.U.P. of the Capital made an erroneous classification in the category of green spaces of a significant number of privately owned lands, although, in reality, the respective lands were never circumscribed to this category. Moreover, the extracts from the land register of the respective lands indicated and continue to indicate unequivocally their classification in the category “construction - yards”.

Alin Oprea  - Associate – and Alexandra Șipoteanu – Junior Lawyer, STOICA & Asociații - analyze in a recent article the legal consequences of this situation and concludes that until the adoption of a new G.U.P. of the Capital, in order to achieve a correct land classification, it is up to the courts to analyse and decide to what extent the partial annulment of the city’s general council decision approving the G.U.P. of the Municipality of Bucharest and the subsequent decisions of extension of its validity.
