AmCham members are kindly invited to a business breakfast with Ms. Cristina Traila, ANRMAP President. Mr. Gheorghe Cazan - General Director, General Division for Policies and Regulation will also attend.
The topics to be addressed are presented below:
- Legal force of the National Authority for Regulating and Monitoring Public Procurement (ANRMAP) notices before the National Council for Solving Complaints (CNSC) and before the courts;
- Clarifications on the practice of certain contracting authorities regarding the draft contract attached as part of documentation, such as providing in the draft contract the contracting authority’s right to unilaterally modify the contract afterward;
- Clarifications regarding the possibility of a tenderer to propose modifications to the draft contract attached as part of the documentation and the way the contracting authority approaches potential proposals;
- The stage of the legislative projects initiated in the past by ANRMAP and submitted to public debates, which have not been approved so far:
o Government Decision for the amendment of G.D. no. 925/2006 for the approval of the application norms of the provisions related to the award of the public procurement contracts provided in Government Emergency Ordinance no. 34/2006;
o Government Decision for the approval of the norms related to the specific procedure for drafting and submitting the claim for the ascertainment that a certain relevant activity is directly exposed to competition on a market to which access is not restricted;
- The stage of the National Action Plan for Green Public Procurement – Ministry of Environment - considering the fact that this will contain, as of 2009, mandatory minimum thresholds for the purchase of ecological products;
- The stage of the initiative promoted by the Ministry of Public Finance for the enactment of the Public Private Partnership Law;
- The possibility to post on the ANRMAP website all opinions expressed with respect to the interpretation of the legislative provisions.
Also, AmCham's recommendations (document attached here) for the amendment of the provisions of Government Emergency Ordinance no. 34/2006 (concerning the award of public procurement contracts, public works concession contracts and services concession contracts, as subsequently amended and supplemented) and of Government Decision no. 925/2006 (for the approval of the application norms for the provisions related to the award of public procurement contracts in GEO no. 34/2006) will be discussed.
