Clifford Chance Badea roundtable: "Arbitration – a better option than courts of law for commercial disputes?

On 24 April 2013 Clifford Chance Badea hosted a roundtable themed: "Arbitration – a better option than courts of law for commercial disputes?" addressing interesting and vexing questions about this form of dispute resolution.

The panel included international experts on the subject: Jason Fry - the former Secretary General of the International Chamber of Commerce ("ICC") International Court of Arbitration ("Court") and a partner at Clifford Chance where he jointly heads the global international arbitration practice; Simon Greenberg – a counsel at Clifford Chance and a former Deputy Secretary-General of the ICC, who was appointed as of July 2012 by the ICC World Council as one of two Members of the ICC Court to represent Australia and Vlad Peligrad – senior associate who leads the Bucharest litigation & dispute resolution practice and is an arbitrator with the Court of International Commercial Arbitration attached to the Chamber of Commerce and Industry of Romania.

Topics included the time- and cost-efficient management of arbitration proceedings, the importance of choosing the right arbitration institution as well as the potential risks in enforcing arbitral awards in certain jurisdictions and the drafting of arbitration clauses. The provisions of the new Romanian Civil Procedure Code regarding arbitration were also debated.
The event was attended by representatives of public and private institutions and major companies from various sectors including, energy, infrastructure, banks and advisory services.
