Nestor Nestor Diculescu Kingston Petersen Intellectual Property Advisory Services (NNDKP IP) assisted Bitdefender in the rebranding project initiated this year by the company. NNDKP IP represented Bitdefender in the procedures of registering its new logos and slogans as a trademark, as essential elements in the process of changing of the company’s visual identity.
The importance of this project derives from the international presence of Bitdefender, which entails the necessity to protect Bitdefender’s new trademarks in different states all around the world, process in which NNDKP IP played an essential role, as part of a collaboration that will continue over the next several years, until the procedures of registering the brands in 60 jurisdictions throughout the world are finalized.
The project involved a team of three lawyers – Ana-Maria Baciu (partner), Delia Belciu (senior associate) and Iulia Ghiță (associate) and an industrial property counselor – Andreea Bende.
One of the problematic aspects of the project was related to identifying the best mechanism for obtaining international registration of the trademarks. ”NNDKP IP has worked in close cooperation with Bitdefender’s representatives in order to identify the best solutions and finally opted for filing for trademark registration in Cyprus, which would then be used as the basis for international registrations. Another practical problem was choosing the best timing in order to ensure the confidentiality of the project before launching it (considering the fact that applications for trademark registration are made public immediately after their submission) without endangering the entire process by postponing the registration procedures”, explains Ana-Maria Baciu, head of the NNDKP intellectual property division.
Some other issues for which the NNDKP IP team identified the optimal legal solutions were related to the fact that 15 of the states that were of interest to Bitdefender are not part of the unitary system of international registration of trademarks, which led to the need to register the trademarks at national level for each of these states. The NNDKP lawyers offered integrated IP solutions, harmonizing the differences between the applicable legal regimes and ensuring the management and coordination of the 15 law firms and private practices specialized in intellectual property in these jurisdictions.

The successful representation of Gaitano Company, a company headquartered in Romania, distributor of the Lumar candies, in the dispute initiated by Soremartec S.A., a company headquartered in Belgium, the producer of the Rafaello pralines, whereby plaintiff claimed the breach of its trademarks due to defendant’s trading of Lumar candies, given the fact the form thereof is identical with the one of the Rafaello pralines. The litigation side of the project was managed by Sorina Olaru (Crețu), partner, while the IP issues were managed by Delia Belciu, senior associate.
The successful representation of Microfibres Inc., company headquartered in the U.S.A., titleholder of intellectual property rights and copyright over several drawings and models registered at community level, against Derby Distribution S.R.L., a company headquartered in Romania, producer and distributor of textile fabrics that contain drawings similar to the ones over which plaintiff holds intellectual property rights. The case was managed by Ana-Maria Baciu and Sorina Olaru (Crețu).
